Terms of Service
The terms behind every booking.
Last updated: October 18, 2026
These Terms of Service ("Terms") govern your use of framefocusmedia.com and the services provided by FrameFocus Media ("FrameFocus," "we," "us," or "our").
1. Acceptance of These Terms
By booking a session and completing checkout on our website, including by checking the box or clicking the button to agree to these Terms, you ("you," "Client") accept and agree to be bound by them. These Terms apply to every booking. We do not require a separate signed agreement for each project. The service, package, price, and scheduling details you select at checkout, together with these Terms, form the agreement between you and FrameFocus Media. If we enter into a separate written agreement with you for a specific project, that agreement controls where it conflicts with these Terms.
You must be at least 18 years old to create an account or book a shoot. When you create an account or book a shoot, we ask you to tick a box confirming you are 18 or older. We keep a record that you confirmed it, and when. If we learn that someone under 18 has an account, we may close it.
2. Services
FrameFocus Media provides professional photography, videography, and drone services across Central Florida, including real estate, rentals and short-term stays, commercial real estate, construction and development, business and brand, equestrian and horse farm, and active adult and senior living work. Aerial work is flown by an FAA-certificated remote pilot under Part 107. The deliverables, scope, and price for each service or package are shown at checkout.
3. Booking and Payment
- Full payment is required at checkout to book and reserve your shoot, unless your account has been approved in advance for deposit or invoiced billing. We do not hold or schedule a date until payment, or an approved deposit, is complete.
- Approved accounts may be set up to pay a deposit at checkout with the balance due afterward, or to be invoiced on agreed terms. These arrangements are made with us in advance and apply only to accounts we have set up for them; they are not available by default.
- Payments are made through our website using Stripe, a secure third-party payment processor.
- We do not store your full card or banking details. Payment data is handled by Stripe under its own terms and privacy policy.
- Prices for each service or package are shown at the time of booking.
- If you book using an email address that already has a FrameFocus account, the booking is added to that account. The people on that account can see, move and cancel it in the client portal, and we send the booking emails to that address. You confirm that the email address is yours or that its owner has given you permission to use it. If you booked on someone else's behalf and need a change, call us at the number on our Contact page.
- If an invoice amount changes after you have made a payment, your payments are credited to it and you pay only the remaining balance. Your portal shows the amount left to pay on the invoice.
- Referrals. You can share the referral code in your client portal. When a new client books their first shoot with your code and their booking is paid, we add $10 of credit to your account. A referral counts only for a new client and never for your own account, and the credit is account credit, not cash, so it cannot be paid out. We may change or end the referral program at any time; a change does not affect a referral that was already paid.
4. Client Responsibilities
You agree to:
- Provide safe, lawful, and timely access to the property or location at the scheduled time
- Ensure the site is ready for the shoot (for example, staged, cleaned, or cleared as agreed)
- Hold the legal authority to permit photography, videography, and aerial capture at the location
- Obtain any consents or releases needed from people who will be identifiable in the media (see Section 9)
- Disclose any hazards, restrictions, or rules that affect access or safety
- Provide accurate booking details, including the correct address, point of contact, and access instructions
If we arrive and cannot safely or reasonably complete the work because the site is not ready, access is denied, or conditions were misrepresented, the cancellation or rescheduling terms in Section 5 may apply.
5. Cancellations, Rescheduling, and Weather
Because you pay in full to reserve your date, the following applies. We count your notice back from the start time of the shoot as it is booked when you cancel or move it, except as described under "If you move a shoot close to its start and then cancel." In every case, we refund any portion of your payment that we do not keep under this section.
Cancellations.
- 24 hours or more before the start: we keep $50 of what you paid and refund the rest. If you paid less than $50, we keep what you paid.
- Less than 24 hours but more than 4 hours before the start: we keep half of what you paid.
- 4 hours or less before the start: we keep everything you paid.
If your booking has no date yet, cancelling refunds everything you paid. Before you cancel in your client portal, it shows what we would keep and what would be refunded, and it offers to move the shoot instead.
Rescheduling. You can move a shoot instead of cancelling it.
- 24 hours or more before the start: no fee.
- Less than 24 hours but more than 4 hours before the start: a $50 rescheduling fee, paid by card before the move takes effect. It also applies when the new time you pick is itself less than 24 hours away.
- 4 hours or less before the start: we do not move shoots online this close to the start. Call us at the number on our Contact page and we will do what we can.
You can move a shoot yourself at most 2 times, and a move that costs the rescheduling fee counts as one of them. To move it a third time, ask us first: your client portal has an Ask to move button, or call us at the number on our Contact page, and we will tell you whether we can. A move that we make, such as a weather reschedule, does not count toward the 2.
On the day of the shoot. You cannot move a shoot yourself on the day of the shoot, even when it is many hours away. We count the day in Eastern time. Ask us first: your client portal has an Ask to move button, or call us at the number on our Contact page, and we will tell you whether we can move it. Cancelling is still open to you on that day, at the cancellation fee above.
If you move a shoot close to its start and then cancel. If you move a shoot when it is less than 24 hours away, you pay the rescheduling fee, and the move stays on record. If you later cancel that shoot, we charge the cancellation fee that applied at the moment you moved it, even if the new date is further away. A move can only be made with more than 4 hours of notice, so that fee is half of what you paid. The rescheduling fee is not refunded. A retainer shoot you cancel after such a move counts as used for its month. A move that we make, such as a weather reschedule, is never counted this way. Your client portal says this before you confirm a move that is less than 24 hours away.
Short notice bookings. A booking made less than 24 hours before the start carries no extra fee. A booking 4 hours or less before the start cannot be made online; call us at the number on our Contact page and we will do what we can.
Weather and conditions. Outdoor and aerial work depends on safe and lawful conditions. If weather, wind, airspace restrictions, lighting, or safety prevents the shoot, we will reschedule at no cost to you. Weather reschedules are always free and are never subject to the fees above.
Our cancellation. If we must cancel and cannot reschedule, you receive a full refund.
6. Drone Operations
All aerial work is performed under FAA Part 107 rules and in accordance with applicable federal and Florida law. You understand and agree that:
- We operate only with your authorization and, where required, the authorization of the property owner.
- Airspace, weather, wind, proximity to airports, temporary flight restrictions, and on-site safety conditions may require us to limit, reschedule, or change the scope of aerial work. Safety and legal compliance always take priority.
- By booking aerial services, you confirm that you have the authority to permit drone flight and aerial capture over and around the property.
- We do not conduct surveillance and capture aerial imagery only within the agreed scope of the project.
7. Delivery and Turnaround
We deliver photography within 24 hours of the shoot and video within 48 hours of the shoot, typically by secure download link or online gallery. These turnaround times may extend for a large or complex project that we flagged to you when you booked, a multi-location shoot, or weather rescheduling, and we will let you know if so.
If we are late. If we miss the 24 hour photo time or the 48 hour video time for a reason within our control, we credit 10% of the price of that shoot to your account, to use toward a next booking. We do not count a delay caused by weather, access to the property, a change you made to the booking, or a large or complex project that we flagged to you at booking. Contact us and we will add the credit to your account. Credit is for a next booking and is not paid out as cash.
We keep the full-size files of your finished media until the date your client portal shows for each shoot, a retention window of 180 days today. After that date we delete the full-size photos, the MLS-size copies and the video files, and the shoot's public listing website is turned off; the web-size copies of your photos stay in your client portal gallery. Please download and back up your files before that date. We may keep selected images for our portfolio and marketing as described in Section 8.
8. Intellectual Property and Licensing
- Copyright. FrameFocus Media retains the copyright in all photographs, video, and aerial footage we create, unless a separate written agreement transfers ownership to you.
- Your license. Upon full payment, you receive a license to use the delivered media for the purpose described in your booking (for example, marketing a specific property, business, or listing), including on websites, listing platforms such as the MLS, social media, and print materials related to that purpose.
- Restrictions. Unless we agree otherwise in writing, you may not resell the media to third parties as a standalone product, claim authorship, or substantially alter the media in a way that misrepresents the property or our work. Edits, filters, or AI alterations applied by you or a third party are your responsibility.
- Third-party use. If others will use the media (for example, a builder, agent, brokerage, or property manager connected to your project), you are responsible for ensuring their use stays within the license granted to you, or they may contact us for their own license.
- Real estate listings. For real estate work, the license is granted to the agent or brokerage that booked the shoot and applies only while that agent's listing agreement with the homeowner is active. You may not give, sell, or transfer the delivered media to another real estate agent for relisting the property or for any purpose other than promotion. Promotional use, such as featuring the work in your own portfolio or marketing, is permitted. When your listing agreement with the homeowner ends, your rights to use the media for that property end as well. Any other agent who wishes to use the media, including for a future listing of the same property, must obtain a separate license from FrameFocus.
- Your MLS. Notwithstanding anything else in this section, you may grant your multiple listing service (MLS) the license its rules require for the listing content you upload to it, including a perpetual, sublicensable license, and that license survives the end of your listing agreement.
- Edited images and MLS rules. Some of our services change what the camera captured: sky replacement, virtual twilight, virtual staging or furniture, object removal, lawn color and similar edits. If you order them, you must follow the labeling and disclosure rules of your MLS and your brokerage, and the law, for altered images. Some require a label on the image, a field you complete, or a note in the listing. Lawn color correction changes how the lawn looks. It is meant for a patchy or seasonally brown lawn, not for hiding dead sod, bare ground or damage, and we may decline an edit that would misrepresent the property. You are responsible for any label an edited image needs. We will not alter a permanent feature of a property or hide a defect. While we still hold it, we will send you the unaltered original of any image we edited if you ask.
- FrameFocus portfolio and marketing use. FrameFocus retains the right to use, reproduce, display, and distribute the media it produces for portfolio, marketing, advertising, social media, website, and award or competition purposes, in any medium and without additional compensation. If your project requires confidentiality, you must request a written exception before the work begins.
- Content we capture for our own channels. While we are on site for any shoot, in any of our specialties, we may also photograph and record the property, its grounds, its surroundings and our crew at work, in addition to your deliverables, for FrameFocus Media's own social media, website and marketing. This content belongs to FrameFocus Media and we may publish and use it as we see fit, without further notice or compensation. You confirm that the property owner, and anyone else whose permission is needed, has agreed to this (see Section 9). We will not publish a person who can be identified without their permission. If you need confidentiality, request a written exception before the shoot.
9. Model and Property Releases
You are responsible for obtaining any model releases, property releases, or other permissions required for people, brands, artwork, or private property that appear in the media at your request or on your premises. You confirm that you have the right to allow us to capture the location and its contents. You agree to indemnify us for claims arising from missing or inadequate releases that were your responsibility to obtain.
10. Revisions and Reshoots
- Digital revisions. Minor edits and adjustments to your delivered images are included if requested within 3 days of delivery. After 3 days, the delivered work is considered accepted.
- Reshoots. A reshoot is an in-person return visit to recapture the location. If a reshoot is needed because of a technical fault in our work, such as images that are out of focus or corrupted, or agreed deliverables that were missed, we will correct it at no charge. Any other reshoot, including a change of preference or a request driven by site conditions, staging, occupancy, or access that were your responsibility, is a paid service at a flat fee of $100, scheduled by mutual agreement and subject to availability.
11. Confidentiality
We treat non-public information you share about your project with discretion and use it only to perform the services. This does not limit our right to use project media for portfolio and marketing purposes under Section 8, unless you have requested and we have agreed to a written confidentiality exception.
12. Refunds
Booking requires payment in full, or an approved deposit or invoiced arrangement as described in Section 3. Refunds for cancellations and reschedules are governed by Section 5. Where a refund is due on an order that used account credit or a promotional code, the credit is returned to your account balance in proportion to the amount refunded, and a single-use code is released for reuse when the order is refunded in full. Once a shoot has been completed and assets delivered, fees for the work performed are non-refundable. Dissatisfaction with creative or stylistic choices that were delivered as agreed is handled through the revision and reshoot process in Section 10, not by refund. We will always work in good faith to address reasonable concerns.
13. Extended Storage, Vertical Cuts, Offer Codes, Gift Codes, and Template Designs
Extended storage. Where we offer it, you may keep a delivered shoot's full-size files for another year beyond the date your client portal shows, for the price shown there when you buy it. We keep the full-size photos, the MLS-size copies and the video files for that year; the web-size copies stay in your portal as always. If we fail to keep the files for the time you paid for, we refund the extension in full; otherwise it is not refundable once paid.
Vertical cuts. Where we offer it, you may order a vertical (9:16) cut of one delivered video, for the price shown in your client portal when you order. Our editor makes the cut from that video and we deliver it to the same gallery, usually within the delivery times in Section 7. Until we deliver the cut, you may cancel it for a full refund; once it is delivered, it is not refundable.
Offer codes. An offer code gives a percent off, an amount off, or one named service free, as stated when we give it to you. It may start and end on set dates, may be limited in how many times it can be used in total or by one account, and may be made for one account only. You can use one offer code on an order. A percent or amount code takes its discount from the services you order, not from a size surcharge or a trip fee. An offer code has no cash value, is not paid out, and cannot be used after it ends. We may end an offer code that was given by mistake or misused. If you cancel or are refunded an order that used an offer code, Section 12 applies.
Gift codes. A promotional code we give away may carry an expiry date and may be withdrawn before it is used. A gift code bought for money never expires, is never withdrawn, and carries no fees. A code is used once, as account credit on the account that redeems it.
Template designs. Each shoot includes five free designs from our template maker. Additional designs are charged at the price shown in your portal before you download them. A design you have paid for or downloaded is final; changing it makes a new design. Every design carries a small "Photos by FrameFocus Media" credit. You are responsible for everything you put in a design: the words, photos, logos and the link a QR code opens. A design must not mislead people, send them to an unlawful or deceptive page, or break advertising rules that apply to you, such as the Florida requirement to show your brokerage's name on real estate advertising and the fair housing laws. A QR code we draw opens only the link you type, and we do not track scans.
14. Disclaimers and Limitation of Liability
We provide our services with professional care. To the fullest extent permitted by law:
- Our services and deliverables are provided on an "as is" and "as available" basis, without warranties of any kind beyond those required by law.
- We are not liable for indirect, incidental, special, or consequential damages, including lost profits or lost business opportunities.
- Our total liability for any claim arising from a booking will not exceed the total amount you paid us for that booking.
- We are not responsible for results outside our control, such as how a listing performs, third-party platform behavior, or edits made to our media after delivery.
14A. Monthly Content Retainers
A content retainer is a month-to-month subscription. These terms apply in addition to the rest of these Terms. Where they differ, this section controls for a retainer; for example, the full payment at checkout in Section 3 does not apply to a retainer shoot, which is covered by the monthly price.
- What you buy. The plan you choose (Starter, Growth or Pro) gives you the number of content shoots shown for that plan each month. Each shoot is a two-hour content session. Travel is included: we do not charge the trip fee on a retainer shoot.
- Price and billing. We charge your card the plan's monthly price when you sign up and again on the same day every month until you cancel. The price you signed up at stays the same until you change plans. If we change a plan's price, the new price applies to new signups, and to you only if you move to a different plan.
- Automatic renewal. Your retainer renews automatically every month until you cancel. You agree to this by ticking the box on the signup page before you enter your card.
- Cancelling. You can cancel at any time from the Retainer page of your client portal. Cancelling ends the retainer at the end of the month you have already paid for, and you keep that month's shoots until then. We do not refund part of a month.
- Changing plans. You can move to another plan from your portal. The change starts with your next payment. There is no pause. If you need a break, cancel and start again later.
- Booking your shoots. Book each shoot from your portal at least a day ahead and before your billing month ends. A shoot you have not booked by the end of the month expires. It does not carry over and is not refunded or turned into money.
- Moving or cancelling a retainer shoot. Moving a booked retainer shoot follows the same rule as any shoot: it is free with 24 hours or more notice, there is a $50 fee with less than 24 hours notice, and with 4 hours or less before the start it can no longer be moved online. Each retainer shoot can be moved online at most 2 times, like any shoot. If you cancel a booked retainer shoot 24 hours or more before it starts, the shoot goes back to your month. If you cancel with less notice, the shoot counts as used. If we cancel a shoot, it goes back to your month.
- Failed payments. If a payment fails we will email you and the payment processor may try again. You cannot book shoots while a payment is overdue. If the payment is not made, we may end the retainer.
- Your media. Media from retainer shoots is delivered under Section 8. You may use it for your own business on social media, your website, ads, email and print. FrameFocus keeps the copyright and the portfolio and marketing rights described in Section 8. Delivered files are kept as described in Section 7, whether or not you keep the retainer.
- Age and account. Section 1 applies: you must be at least 18, and the retainer belongs to the client account that signed up.
15. Indemnification
You agree to indemnify and hold harmless FrameFocus Media from claims, damages, losses, and expenses arising from your breach of these Terms, your failure to obtain required permissions or releases, your misrepresentation of site conditions or authority, or your misuse of the delivered media.
16. Force Majeure
Neither party is liable for delays or failures caused by events beyond reasonable control, including weather, natural disasters, equipment failure, airspace restrictions, government action, illness, or other unforeseeable events. We will reschedule affected work in good faith.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Lake County, Florida, and you consent to that venue. Before filing any claim, the parties agree to attempt to resolve the matter in good faith through direct discussion.
18. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date reflects the most recent version. Your continued use of our website or services after a change means you accept the updated Terms.
19. Entire Agreement and Severability
These Terms make up the entire agreement between you and FrameFocus Media regarding your booking, unless we have signed a separate project agreement with you. If any part of these Terms is found unenforceable, the rest remains in effect.
